PHC Law Recovers £25,000 Compensation for Welding Machine Operator

The Claimant was injured in an accident which occurred at work on 17th April 2008, and called upon PHC Law’s specialist personal injury solicitors to handle her claim.

Whilst operating a welding machine which required quick, repetitive movements in order to keep production going, due to a momentary and inadvertent lapse of concentration, the Claimant pressed the pedal and caused the welding device to crush her hand.

The injury caused significant damage to the right index finger, which left her with a painful and sensitive tip. This prevented the Claimant from carrying out most activities which involved using the right hand, and negatively affected both her personal and working life. In the meantime, the Claimant was affected by a significant back condition which also impaired her ability to work.

Medical evidence was obtained from a Consultant Orthopaedic Surgeon and despite the Claimant’s employers failing to cooperate and delaying their investigations, the insurers admitted liability but argued for contributory negligence.

On behalf of the Claimant, Mr Cooper, representing her case, contended that there would be no contributory negligence as the accident occurred due to an extremely dangerous system of work involving an unsafe piece of machinery.

Mr Cooper commented: “The accident has caused great deal of pain, suffering and distress for my client. Although I am pleased with the outcome for my client, these types of accidents should not happen. It is every employer’s duty of care to maintain a safe working environment for its employees to prevent accidents from happening.

“The immediate cause of this accident was inadvertence, which was bound to occur when an operative was required to work in a repetitive fashion. Proceedings were commenced after the insurers admitted liability, and the Claimant received £25,000 compensation in full, without any deductions.
